This policy outlines the intellectual property rights and ownership terms for all deliverables Black Tiger Digital creates for our clients. We believe in transparency and clarity about who owns what.
Overview
When you work with Black Tiger Digital, various types of intellectual property are created, used, and exchanged. This policy clarifies ownership rights for each type of asset so there are no misunderstandings.
Custom work created specifically for you, including designs, content, and configurations unique to your project.
Pre-existing tools, frameworks, methodologies, and reusable components that we use across multiple projects.
The Simple Rule: If we created it specifically and exclusively for you, you own it upon full payment. If it existed before your project or will be used for other clients, we retain ownership but grant you a license to use it.
What You Own
Upon full payment of all invoices, you own the following deliverables outright, with full intellectual property rights:
Full Rights: For all items listed above, you receive full, exclusive, perpetual, worldwide rights to use, modify, distribute, and sell as you see fit.
What Black Tiger Digital Retains
We retain ownership of the following assets, which we license to you for use in your project:
License Grant: For all items we retain ownership of, we grant you a non-exclusive, perpetual license to use them as part of your deliverables for as long as your project remains active. This license allows your website to function properly.
Third-Party Assets and Licenses
Your project may include third-party assets that are neither owned by you nor by Black Tiger Digital. These are governed by their respective licenses.
Transfer of Ownership
Ownership of client deliverables transfers according to the following terms:
Until Full Payment: Black Tiger Digital retains all intellectual property rights to deliverables until payment is received in full. We reserve the right to withhold files, disable access, or remove work if payment obligations are not met.
Portfolio and Promotional Rights
We take pride in the work we create and appreciate the chance to showcase it. By default, we retain the right to use completed work for promotional purposes.
What We May Use
Where We May Feature Your Work
Opt-Out Available: If you prefer your project not be used for promotional purposes, let us know in writing before or during the project. We will honor all confidentiality requests.
Upon Termination or Cancellation
If our working relationship ends, the following terms apply to intellectual property and deliverables:
If Fully Paid
- You retain ownership of all client deliverables
- We provide all source files and assets
- Access credentials are transferred to you
- We assist with the transition to a new provider
If Not Fully Paid
- We retain ownership of all deliverables
- Work may be removed or disabled
- Source files are not provided
- Access may be revoked
